Now, because of the poor response, CMS issued a Program Transmittal on April 2, 2004 that essentially states if the after contacting the provider and the provider fails to produce the requested records, the carrier is to refer the recalcitrant provider over to the OIG (Office of the Inspector General) if the aggregate sum of billed claims exceeds $40. Background The OIG issues an annual report on Improper Medicare Fee for Service Payments.
