If the scratch is too big or if there are several, then you need a new disc. The file would only be in use if the game is already running, which it obviously isn't, as you are trying to install it. The problem is probably the scratches. Nah those discs are sketchy, it happened to my original Halo disc too, and the scratch is very minor. I ended up buying another disc for 20 bucks, but I guess since you have a legit code you could figure something else out if you get my drift.
